Following Carr's decision, Max Flugrath, the communications director for Fair Fight Action, a voting rights advocacy group in Georgia, wrote on X that the state's law was clear, "Kemp has the responsibility. The AG's opinion leaves a gaping hole where accountability should lie."

In another post, Flugrath cited legislation that allows the state's governor to conduct a hearing on formal charges raised against Election Board members.

According to Flugrath, Georgia Code § 45-10-4 says, "If such charges are found to be true, the Governor shall forthwith remove such member from office."

CNN legal analyst Norman Eisen agreed with Flugrath, describing the ruling as a "shocking abdication of responsibility."

"Leadership is stepping up and dealing with illegality, not burying your head in the sand," he wrote in a post on X.

Democratic state Senator Nabilah Islam Parkes, who had called on Kemp to act against the Election Board members, wrote on the platform: "The attorney general is providing cover for the MAGA election board members. His opinion is engaging in intellectual dishonesty."

"We have received the opinion and just as he has done in the past, the governor will follow the laws and constitution of our state," Garrison Douglas, Kemp spokesperson, told CNN on Friday.

We hear about countries that have (mediocre) national health insurance, but do you ever hear liberals tell us about countries that require voter ID, like Haiti?

In the US, massive majorities of voters support voter ID laws. A recent Pew Research poll found 81% support for voter ID overall, with Hispanics at 85%, Asians at 84%, and African-Americans at 75%. 

Who is keeping this off the ballot?  he people who say zero evidence of vote fraud have zero evidence of election security.

Wisconsin's absentee ballot loophole: Four years ago, the Dairy State was one of three narrowly decided states, along with Arizona and Georgia, that tipped the presidential election in Joe Biden's favor. And if a particular loophole in Wisconsin's election system isn't fixed, we might see that state go narrowly to Kamala Harris. "Election Integrity deniers often complain that Wisconsin has one of the more stringent voter ID laws in the country. That's a good thing," The Federalist reports. "But there's a voter ID-related loophole cheaters can drive a semi truckload of fraud through. In Wisconsin, voters may claim 'Indefinitely Confined' status, which allows them to receive an absentee ballot without presenting proof that they are who they claim to be." This "indefinitely confined" loophole is a remnant from the COVID days, and it allows anyone to receive an absentee ballot without having to show a photo ID. Thus, it's a recipe for bulk-mail ballot fraud, and Republicans would be wise to fix it. Otherwise, some 144,000 Wisconsin voters are still eligible to vote without showing ID.

Another source I've no experience with, but this has the ring of truth. If only intrepid journalists bothered to do their jobs:

There is a massive story for someone who has more resources than I have to investigate this further.

In 1977, the Department of Justice Civil Department required Congress to sign off on any settlement against the United States more than 100,000.00 dollars. But as society became more litigious, the cap was eventually removed. Then the DOJ civil department became one of the most powerful departments in the United States Government, basically, they could do whatever they want with Taxpayer money. The account became known as the Judgement Fund. The fund's operations have become secretive and often nefarious.

In 2009 a man named Tony West took over the Department of Justice civil litigation program. This program was in charge of settling lawsuits against the federal government. But this was an email that Tony West got upon being appointed to the job:

 “can you explain to Tony the best way to allocate some money toward an organization of our choosing?”

That is how taxpayer money became the vehicle to start funding Left Wing associated organizations and give them the resources needed to start what has become the party of lunacy.

For example in 2010, the DOJ had all but won a case in Supreme Court after a decade long fight DOJ lawyers were on the verge of winning a case against discrimination claims by 91 Hispanic and female farmers.

Tony West personally intervened and the
DOJ agreed to a $1.33 billion settlement which included thousands of farmers who had never claimed bias, and of course ATTORNEY FEES in the millions. More importantly, the case lawyers vehemently was against the settlement noting they had obviously were going to win the case and not cost the taxpayers money at all. Law firms, some which did not even participate in the case were awarded an additional 133 million in attorney fees.

The projected settlement size ballooned to over $4.4 billion as additional plaintiffs were added, including Native American farmers.

One government expert was appalled: “‘If they had gone to trial, the government would have prevailed . . . It was just a joke. . . . I was so disgusted. It was simply buying the support of the Native Americans.’”

Sound Familiar? Kind of like forgiveness of student loans, promises of cash for down payment on houses.

This dirty deal also inflated the number of claimants, creating a $60 million windfall for the plaintiff’s lead lawyer, a member of the Obama/Biden transition team.

Tony West did not just shakedown taxpayers, he also went after any right-wing corporations.

In a series of bank settlements, West wrote in PROVISIONS TO THE SETTLEMENTS THAT
Donations were mandatory and be given to DEMOCRAT ACTIVIST SUPPORT GROUPS. (Perhaps those shills we see like Brooklyn Dad, JoJo From Jerz, you know, all the paid propagandists we see on Twitter)

What makes things worse, is his settlements specifically provided that right wing groups were not eligible for any of these payments. This was around the same time Obama was having the IRS target right wing not for profit groups also.

An internal email shows West deputies rewording a settlement’s donation provisions to ensure the bank could not select a “conservative” property rights organization as a recipient. In 2016, before Trump took office, a 2 billion Electric Car initiative was mandated although explicitly rejected by Congress.

An email circulated saying they ought to build a “statue” to West and “bow down to this statue each day after we receive our $200,000+.”

Who was signing off on all these corrupt settlements in California? California’s attorney general at the time, Kamala Harris, was an active participant, cosigning agreements for her state.

Then, Donald Trump was elected and immediately ended the Judgement Fund. In fact, his attorney general banned them altogether citing the misuse, allocation and dangers of such a fund.

But a funny thing happened, in 2020, the Biden/Harris administration reversed the ban and started the fund up all over again. Once again, left wing organizations are getting billions of dollars in settlements while conservative groups are ineligible. You remember FBI Agents Peter Strzok and Lisa Page? This is the fund that paid them their multi million dollar settlement although they had no expectation of privacy by sending texts on government issued phones. Perhaps that Plan "B" that they talk about how they would stop Trump in those texts was the reason for such a payout.

But you may ask, who is Tony West? Well, He is Kamala Harris's Brother-in-Law and is expected to be named White House Counsel if she is elected.

This guy makes Hunter Biden look like Mother Theresa, as the New York Post aptly said;  A new “Big Guy” is coming to town. Kamala, with the help of Tony West and his cronies, will show you how Honest Graft is really done.--Dishonestly

But where the story really is, all that money that was spent on dishonest settlements have been coming back to the Harris campaign in spades.

Florida Secretary of State Cord Byrd said the National Voter Registration Act (NVRA) and federal courts said states cannot require proof of citizenship to register to vote, and states are playing “whack-a-mole” with noncitizens who have repeatedly registered to vote after being removed from voter rolls.
Why It Matters: The number of noncitizens registered to vote is likely much higher than what states are reporting to have removed from their voter rolls. Biden’s Executive Order 14019 making federal agencies “voter registration agencies” is likely contributing to voter registration of noncitizens, but more importantly the expansive network of voter registration nonprofits have been acting as effective “voter registration agencies” for much longer. – R.C.

State’s highest court to take ‘naked ballots’ case over mail-in voting issues

By Mark Scolforo ASSOCIATED PRESS HARRISBURG, PA. | Pennsylvania’s highest court on Friday said it will consider whether counties must accept provisional ballots cast on Election Day at polling places by voters whose mail-in ballots lacked secrecy envelopes or were rejected for other flaws.

It could determine the fate of thousands of votes that could otherwise be canceled in the Nov. 5 election, when Pennsylvania is considered a critical state in the presidential race.

The Supreme Court took up the appeal from a Commonwealth Court decision just two weeks ago that said Butler County had to count provisional ballots from two voters who had received automatic emails before the April primary telling them their mail-in votes had been rejected because they were so-called “naked ballots” that weren’t enclosed in the provided secrecy envelope.

When the two voters tried to cast provisional ballots, elections officials in Republican-majority Butler County rejected them, prompting a lawsuit. The voters lost in Butler County court but on Sept. 5 a panel of Commonwealth Court judges reversed, saying the two votes must be counted.

The case is among several lawsuits over the fate of Pennsylvania mail-in ballots cast by voters who failed to follow the rules in sending them in to be counted, most notably the much-litigated requirement for accurate, handwritten dates on the exterior envelopes.

Democrats have embraced mail-in voting far more than Republicans since Pennsylvania lawmakers greatly expanded it five years ago, on the eve of the pandemic.

The decision to take the case comes a week after the Pennsylvania Supreme Court overturned Commonwealth Court in a separate mail-in ballot case, effectively allowing counties to enforce the exterior envelope date mandate.

The order issued Friday said the justices will consider whether counties must count provisional ballots cast by voters who fail to submit their ballot in a secrecy envelope — the issue that tripped up the two Butler voters.

But the high court indicated it also may rule on the wider issue of permitting provisional ballots for voters whose mail-in ballots get rejected for other reasons.

The appeal was brought by the Republican National Committee and the Republican Party of Pennsylvania, which argued Commonwealth Court was establishing court-mandated ballot curing that is not authorized in state election law.

The Supreme Court set deadlines next week for the GOP entities, the two Butler voters who sued and the state Democratic Party that’s on their side as well as others who want to weigh in.

Provisional ballots that are typically cast at polling places on Election Day are separated from regular ballots in cases when elections officials need more time to determine a voter’s eligibility to vote.

County officials run elections in Pennsylvania. It’s unclear how many of the state’s 67 counties do not let voters replace a rejected mail-in ballot with a provisional ballot, but the plaintiffs have indicated at least nine other counties may have done so in the April primary

Heritage Foundation video shows noncitizens who say they’re registered to vote

By Stephen Dinan THE WASHINGTON TIMES

The Heritage Foundation says it has video evidence of people who aren’t U.S. citizens living in Arizona and hoping to vote in this year’s presidential election.

The video was recorded at the Los Vecinos Apartments in Phoenix. Heritage’s Oversight Project went door-to-door and said it found six people who said they were not citizens but were registered to vote anyway.

Some of them indicated they would cast a ballot for Ms. Harris if they could.

“Did you register here or at work?” the Heritage investigator asks in Spanish, posing as a community organizer. “At work,” one replies in the video.

“Are you a citizen?” the investigator prods. “No,” the person says.

Others said they were registered at home or when they went to migrant services centers.

One man seemed to struggle with his vote.

“Look, Trump is a businessman. Kamala Harris isn’t a businesswoman,” the unidentified man says in the translation provided by Heritage. “But I think Kamala is with the community, but things will stay the same.”

He worried that she might not keep her campaign promises, but he also seemed concerned about Mr. Trump’s announced plans for a wave of deportations.

The Heritage Foundation is a conservative think tank in Washington.

The people on the video are not identified, and there is no way of knowing whether they are in fact registered or determining their actual citizenship status.

The video comes amid a fierce debate over the surge of newly arrived immigrants who are in the U.S. illegally and whether they would, illegally, be able to register and cast ballots this year.

Democratic elections officials and many media outlets have called noncitizen voting a myth, saying it rarely happens.

GOP election officials, though, have identified thousands of names on rolls in their states, and say election records show some of them did cast ballots.

The Justice Department weighed in earlier this month with a warning to state officials to tread lightly in trying to clean up their voter rolls.

In new guidance to states, the department said federal law allows states to scrub their lists but it must be done within strict guidelines and only for approved reasons, such as a voter has moved out of the jurisdiction, has died or has requested removal.

Changes cannot be made close to an election, the department said.

The guidance is largely a restatement of Justice Department interpretation of federal election law, but the timing irked key members of Congress, including Rep. Bryan Steil, chairman of the House Administration Committee.

“The guidance document appears designed to intimidate, rather than assist, those tasked with ensuring the integrity of our electoral process,” the Wisconsin Republican wrote in a letter Thursday.

He said the Justice Department should be helping states clean their rolls rather than taking an “aggressive” stance against them.

The Washington Times has sought comment from the Justice Department for this story.

By Marc Levy ASSOCIATED PRESS HARRISBURG, PA. | Left-leaning groups and voting rights advocates asked Pennsylvania’s Supreme Court on Wednesday to stop counties from throwing out what could be thousands of mailin ballots in November’s election in a battleground state that’s expected to play a critical role in picking the next president.

The lawsuit, filed directly to the state’s highest court, is the latest attempt by the groups to ensure counties don’t reject mailin ballots that have an incorrect or missing date on the ballot envelope.

The suit was filed six weeks before the presidential contest and comes as mail-in voting is just beginning in the state. It is at least the third election-related case now pending before the state Supreme Court.

Pennsylvania law states voters must date and sign their mail-in ballot. Voters not understanding that provision has meant that tens of thousands of ballots lacked an accurate date since Pennsylvania dramatically expanded mail-in voting in a 2019 law.

But the lawsuit’s plaintiffs contend that multiple courts have found that a voter-written date is meaningless in determining whether the ballot arrived on time or whether the voter is eligible. As a result, rejecting someone’s ballot either because it lacks a date or a correct date should violate the Pennsylvania Constitution’s free and equal elections clause, the plaintiffs said.

The parties won their case on the same claim in a statewide court just four weeks ago over Republican opposition. But it was thrown out by the state Supreme Court on a technicality before justices considered the merits.

Democrats, including Gov. Josh Shapiro, have sided with the plaintiffs, who include the Black Political Empowerment Project, Make the Road Pennsylvania, Pittsburgh United, the League of Women Voters of Pennsylvania and Common Cause Pennsylvania.

Republicans contend that requiring the date is an election safeguard and accuse Democrats of trying to change the rules of elections at the 11th hour.

The court, with five justices elected as Democrats and two as Republicans, is playing an increasingly important role in settling election disputes in the lead up to the presidential election in Pennsylvania, much as it did in 2020’s presidential election.

Issues around mail-in voting are hyperpartisan: Roughly three-fourths of mail-in ballots in Pennsylvania tend to be cast by Democrats. Republicans and Democrats alike attribute the partisan gap to former President Donald Trump, who has baselessly claimed mail-in voting is rife with fraud.

Justices still must vote on whether to take the case filed Wednesday.

Justices also do not have to take another case brought to it last week by the Republican National Committee and the state Republican Party that seeks, in part, to settle cases emerging from lower courts that involve similar issues.

In its lawsuit, the GOP wants the high court to restrict counties from telling voters if it will reject their mail-in ballot. Mr. Shapiro’s administration has put procedures in place to notify those voters to give them time to fix a garden-variety error or cast a provisional ballot in its place

Cheating Dems sent out 2,200 duplicate ballots in Madison: Wisconsin and its 10 electoral votes went into Joe Biden's column by a razor-thin 11,000 votes in 2020. So it stands to reason that the Democrats are worried about the Dairy State's status this cycle. We say this because the polling in the state is essentially tied now, and because an infamous ABC News-Washington Post poll just two weeks prior to the 2020 presidential election showed Donald Trump trailing Biden there by a ridiculous 17 points. Evidence of the Democrats' desperation appeared this week in the liberal college city of Madison, the state's second-largest city, where we learned) that more than 2,200 voters there were sent duplicate absentee ballots. Not to worry, though. The city clerk is "rectifying a data processing error" and working to ensure "safeguards" prevent double voting. Color us less than convinced. Democrats value nothing above political power, and Madison has had its share of electoral "problems" in recent years.

Election officials begin assessment of voting machines

Called logic and accuracy testing

Elections officials across Pennsylvania have begun assessing their voting machines using a procedure known as logic and accuracy testing, which helps confirm their equipment is working properly ahead of Election Day.

All election equipment used by Pennsylvania counties — ranging from ballot-marking devices used for some in-person voting to machines that tabulate mail and absentee ballots — is put through this preelection stress test.

Counties in the commonwealth are required by law to conduct logic and accuracy testing before any election, according to the Pennsylvania Department of State. All states do similar testing.

“Really, we are testing the voting system end to end,” said ForrestLehman, director of elections and registration in Lycoming County. “It’s almost like we’re running a small-scale election.”

During logic and accuracy testing, election officials create sample ballots with various configurations of layouts and votes, which is known as a “test deck.”

The test deck includes ballots that are designed to trigger warnings or fail, such as ballots with no votes at all or too many votes in a contest. The test deck is run through the machines to ensure they are counting votes accurately and flagging errors.

This process helps officials confirm not only that the machines are working properly but that ballots are laid out properly and don’t have any proofing errors, such as missing candidates.

“Logic and accuracy testing, combined with post-election audits of the voted ballots, consistently provide evidence that voting machines are doing what they’re supposed to do,” said Mark Lindeman, director of policy and strategy at Verified Voting, a group that tracks voting technology in the U.S. “The systems and processes are good, and they’re getting better.”

Pennsylvania counties have until 15 days before the election to certify that they have completed the logic and accuracy test. How long it takes them varies.

Philadelphia have finished its testing on central tabulation scanners for mail ballots and ballot marking devices used for in-person voting, Nick Custodio, deputy to Philadelphia City Commission Vice Chair Lisa Deeley, wrote in an email. Local officials will continue to conduct a “functional test” on all ballot marking devices, a process that will take at least another week.

Snyder County Director of Elections Devin Rhoads anticipates his county’s testing will begin in October and be “wrapped up in three days.”

Pennsylvania counties also are required to notify the chairs of local political parties when and where they will conduct logic and accuracy testing. Counties should also notify the public, according to the Pennsylvania Department of State. Mr. Rhoads said anybody who wishes to observe Snyder County’s testing is welcome.

“We’re open and transparent,” Mr. Rhoads said. “If I have a person who is questioning or doesn’t believe in the system or is worried about conspiracy theories and they want me to hold their hand and show them and everything, what’s going on, I will do that.

Based on the latest available data and an enhanced version of a stress-tested methodology from a scholarly journal, a new study by Just Facts has found that about 10% to 27% of non-citizen adults in the U.S. are now illegally registered to vote.

The U.S. Census recorded more than 19 million adult non-citizens living in the U.S. during 2022. Given their voter registration rates, this means that about two million to five million of them are illegally registered to vote. These figures are potentially high enough to overturn the will of the American people in major elections, including congressional seats and the presidency.

In 2014, the academic journal Electoral Studies published a groundbreaking study by three scholars who estimated how frequently non-citizens were illegally voting. Based on data for the 2008 presidential and congressional elections, the study found that:

The authors calculated voter turnout with the same datasets, but their methodology yielded a best estimate that 6.4% of non-citizens voted in 2008—lower than the 8.0% of non-citizens who stated “I definitely voted” and explicitly named the candidate they voted for. This and other matters led Just Facts to engage in extensive correspondence with the lead author of the study to verify practically every detail of it.

Just Facts then conducted a comparable study that used the same datasets, a more straightforward methodology, and related studies to constrain assumptions. This found that roughly 27% of non-citizens were registered to vote and about 16% of them voted in the 2008 national elections.

Hard to believe and hard to measure but if illegals vote in numbers and proportions 1/100th of what they calculate, it is enough to swing the 2020 (or 2024?) election.

do pollsters actually ask or know if those surveyed or US Citizens and then exclude those who say they are not?
Some will lie and say they are as noted in above article and common sense thought will conclude that.

Do they take into account those who are not citizens who vote?

I doubt it.

In which case I have a very bad feeling about the election clearly with many thousands of paid people sent out all over the swing states to gather ballots - one way or the other .

80% figure for non citizens voting Dem seems to be consistent with everywhere I read.

And yet they are the deniers of math, science, history, logic and nearly everything common sense, like the excess spending blew open the inflation, lower tax rates cause more investment, military strength deters enemies, hurricanes pre-date fossil fuels, an unborn the day before it's born is the same being as the day after it's born, etc.

The UOCAVA voting loophole allows anyone to make up a fake name, pretend they are living overseas, and vote as many times as they like. Federal law prohibits states from verifying identity and citizenship. These are untraceable ballots. If you thought 2020 was bad 2024 is going to be a bloodbath.

In the meantime, the horrific government response to the tragedy caused by Hurricane Helene, a traditional stronghold of Republicans, is so bad that absent some effort I’ve not yet seen, thousands of people in Georgia and North Carolina will be unable to cast their ballots.

Texas Attorney General Ken Paxton asked the Homeland Security Department on Monday to verify the citizenship status of more than 450,000 names on the state’s voter rolls, saying that while the vast majority are likely eligible to vote, he wants to weed out those who aren’t.

The demand is the latest in a renewed effort by GOP-led states to try to clean their voter rolls amid the unprecedented surge of illegal immigration.

Mr. Paxton said federal law requires the national government to help states verify citizenship and he’s asking the Biden administration to make good on that.

“I am confident that you will continue to comply with your legal obligations and provide the requested citizenship or immigration status to my office so that I may ensure Texas elections are fair and secure,” Mr. Paxton wrote in a letter to Ur Jaddou, director of U.S. Citizenship and Immigration Services.

Texas says it already verifies citizenship status for people who obtain state driver’s licenses or identity cards, so anyone who used that to register to vote is in the clear.

But he said 454,289 names on the state’s voter rolls registered with other documents, therefore the state cannot be sure of their citizenship status.

“Although I have no doubt the vast majority of the voters on the list are citizens who are eligible to vote, I am equally certain that Texans have no way of knowing whether or not any of the voters on the list are noncitizens who are ineligible to vote,” Mr. Paxton wrote.

The Washington Times has sought comment from USCIS.

Texas recently revealed it removed 6,500 people from its voter rolls that it deemed ineligible noncitizens. Of those, the state said 1,830 had cast ballots in previous elections.

Republicans have been focusing on noncitizen voting in elections as part of a broader push questioning the integrity of U.S. balloting.

Democrats say the concerns are overblown, insisting that noncitizen voting happens rarely enough to not be worthy of concern, particularly when the steps taken to weed out noncitizen voters could end up snaring eligible citizens, too.

The Justice Department has warned states to be cautious in any attempt to clean voter rolls at this point.

Last week, the department filed a lawsuit challenging Alabama’s decision to place 3,251 names on its inactive voter list, saying the move took place too close to an election.

As part of its complaint, the Justice Department said some of the names removed from Alabama’s rolls included citizens.

Alabama said the names had shown up in state databases for people applying for unemployment benefits or a driver’s license or identity card and had indicators showing they weren’t citizens.

Secretary of State Wes Allen said it’s “possible” some were citizens now. Indeed, as of the middle of September, more than 700 people had verified their citizenship and returned to the active voter rolls.

Just 106 people who got the notices asked that their names be removed — and even then, that wasn’t a firm indicator that they were noncitizens.

Mr. Allen said he made “repeated requests” to the federal government for a list of noncitizens living in Alabama to use in checking voter lists, but the administration “declined” those entreaties
