Well, I had the wrong solstice. In the many times we’ve discussed today’s scenario on the podcast and in print, I predicted the Biden Justice Department would give Hunter a sweetheart plea deal right before Christmas, when Washington traditionally does its worst as people tune out the news.

Turns out it was just as summer was about to begin . . . when people are paying attention to the news, when the Biden Justice Department’s special counsel has just charged Donald Trump with 37 felony counts, and when Democrats are trying every way they can think of, without a scintilla of embarrassment, to rile up the Trump-friendly GOP base in hopes of getting Republicans to nominate Trump for the presidency.

Gotta love it when a plan comes together.

Here’s what I wrote six weeks ago:

In a friendly interview on MSNBC on Friday, [President Biden] made it clear to his subordinates at the Biden Justice Department that he has determined his son Hunter should not be charged with a crime. “My son has done nothing wrong,” said the president. “I trust him. I have faith in him, and it impacts my presidency by making me feel proud of him.”

This was blatant interference in the moribund investigation. The Justice Department and its assigned prosecutor, Delaware U.S. attorney David Weiss, have recently come under significant pressure due to whistleblower allegations from law-enforcement agents that there has been significant political interference in the probe and that the FBI has supposedly been sitting on evidence that implicates the president in a bribery scheme.

This has led to speculation that the scam I’ve been predicting for a couple of years is imminent: The Justice Department could soon give Hunter a sweetheart plea deal in which he would admit guilt to the undeniable — a minor tax charge or two, plus, perhaps, a false statement on a required federal firearms form, concealing his drug abuse. Swept under the rug would be the part of the investigation that really matters: The gross monetization of Joe Biden’s political influence and what foreign adversaries like China believed they were buying.

Yup.

Under Justice Department policy, even with a plea agreement, the government is supposed to seek a plea to the “most serious,” readily provable “offense that is consistent with the nature and full extent of the defendant’s conduct.” Hunter Biden committed tax offenses that could have been charged as evasion, which is punishable by up to five years’ imprisonment for each count. Furthermore, he made a false statement that enabled him to obtain a firearm; that’s a ten-year felony under legislation pushed through by then-senator Joe Biden to show how very serious Democrats are about gun crime.

Biden apologists have tried to minimize that transaction as a “lie and try” case, which they say is often not prosecuted. But such non-prosecution (though it shouldn’t happen) occurs because of what you’d infer from the “try” part — i.e., the liar got caught and failed to obtain the gun. Hunter’s case, to the contrary, is a lie and succeed case. He got the gun. What’s more, he was then seen playing with it while cavorting with an “escort” (see the New York Post’s pictorial, if you’ve got the stomach for it). Shortly afterwards, he and his then-paramour — Hallie Biden, the widow of his older brother — managed to lose the gun near a school (it was later found by someone else).

Those are the kinds of gun cases that get charged by the Justice Department even if the suspect hasn’t, in addition, committed tax felonies by dodging taxes on the millions of dollars he was paid, apparently for being named Biden. Yet after refusing for years to appoint a special counsel despite the five-alarm conflict of interest attendant to investigating the president’s son ( . . . and family . . . and the president himself), the Biden Justice Department is permitting Hunter Biden to dispose of the case with misdemeanor tax charges that will allow for a probation sentence, and diversion — essentially, no prosecution — on the gun felony that would result in imprisonment for most Americans who engaged in similar conduct.

Quite a deal.

Last week, Trump was flirting with 60 percent in GOP primary polling after being indicted, with a 45-point lead in some surveys. Democrats seem bound and determined to get him to 70.

In response to the above post showing Garland criticizing those who call the DOJ biased is an attack on democracy

I say the following


like Marc Levin said recently on his radio show

this is a prime example of why so many people hate lawyers

the legal world according to garland:

justice applying and enforcing laws equally and thoroughly
is really justice being applied at the discretion of lawyers to whom they want and to not apply to whom they want.

just keeping twisting and bending "legal arguments" in all directions at will and at convenience and to fit personal agendas

I recall an attorney who upon retiring was lauded in the Palm Beach Post newspaper in the early 90's when I lived in WBP across from Mar a Lago.

He was given a verbal standing ovation for upholding justice having a stellar reputation for honesty integrity and fairness.
He was asked about the decline in ethical legal standards and his response was, I always remembered was
something to the effect that unethical legal behavior used to be the exception to the rule (of law[yers]) but had become prevalent to about half only at that time.

That was 30 yrs ago.......

There are many unethical doctors too so do not get me wrong as though I am just picking on lawyers

We need lawyers and some are very good ;  but they certainly do not seem to be honest in DC or the ones in the political profession .....

President Biden has campaigned far and wide that America’s rich should pay their “fair” share of taxes, and he’s giving the Internal Revenue Service billions more to enforce it. Does he include his son Hunter among the rich who should pay what they owe?

The question is highly relevant after last week’s under-reported testimony from two IRS whistleblowers about their investigation of Hunter’s taxes. Hunter agreed to plead guilty last week to two misdemeanor charges of “willful failure” to pay some $200,000 in tax for years 2017 and 2018. But the two whistleblowers, testifying under oath before the House Ways and Means Committee, revealed details of Hunter’s tax maneuvering that make a mockery of his father’s tax moralizing.

The agents reported that an IRS team in January 2022 finalized a document of some 80 pages recommending that Hunter be charged with tax violations for each of his six tax returns from 2014 through 2019.

IRS supervisory special agent Gary Shapley said Hunter’s 2014 and 2015 returns involved a “scheme to evade his income taxes through a partnership with a convicted felon.” At issue was the $83,000 a month Hunter received to sit on the board of Burisma, the Ukrainian energy company. The second (anonymous) whistleblower explained that in 2014 Hunter arranged a series of “sham” transactions so he “didn’t report any of the money he earned from Burisma”—about $400,000 in 2014.

The whistleblowers say Hunter directed Burisma to pay his money to Rosemont Seneca Bohai, or RSB, an entity owned by his business partner Devon Archer, who was convicted of fraud in 2018. They say RSB would send the money to Hunter, who then “booked it as a loan.” One obvious tax problem, explains the second whistleblower, is that “you can’t loan yourself your own money.”

Mr. Shapley says this loan ruse is a “textbook” evasion scheme, something “I learned at basic training.” When someone claims a payment is a loan for tax purposes, the IRS looks for three things: You’ve “got to have a promissory note, you got to have defined interest, and you got to have repayments,” Mr. Shapley says. In Hunter’s case, “none of those were included.” RSB also booked the payment as an “expense”—meaning that “even the two parties didn’t treat it the same way.”

The committee also released an email showing that another Hunter business partner, Eric Schwerin, told Hunter in 2017 that Hunter had “unreported Burisma income” and needed to “amend your 2014 returns.” Hunter ignored the warning and later that year ended his relationship with Mr. Schwerin.

The second whistleblower says 2014 records show RSB paid more than $10,000 in Hunter medical bills, and purchased a $142,000 Porsche for Hunter’s benefit via other money from a Kazakhstan businessman. The whistleblower says Hunter didn’t report this as income.

The IRS team recommended that Hunter be prosecuted on felony charges of tax evasion for 2014 and false tax filings and a misdemeanor charge for 2015 of failure to pay tax. Yet because the U.S. Attorney waited so long to make a prosecutorial decision, the six-year statute of limitations expired. Hunter thus won’t pay taxes on more than $400,000 in unreported income for these years. Mr. Shapley says: “The purposeful exclusion of the 2014 and 2015 years sanitized the most substantive criminal conduct and concealed material facts.”

Also notable are Hunter’s filings in 2018 and 2019, for which the IRS team also recommended felony charges of tax evasion and false returns. The second whistleblower testified that Hunter underreported his income for 2018 by anywhere from $267,000 to $500,000—depending on how conservatively the IRS counted. He did this, claims the whistleblower, by falsifying “business” deductions.

The whistleblower says this included deducting thousands paid to “no-show employees”—including “a prostitute” that Hunter claimed was a “West Coast assistant.” He deducted $10,000 for a “golf club member deposit,” money that IRS agents say “went to pay for a sex club.” He deducted $30,000 for a child’s Columbia University tuition. He also deducted a hotel room for who agents believed to be “one of his drug dealers,” hotel rooms for his girlfriend at the time, and two nights for “a hotel room for his dad, Joe Biden.”

The IRS agents say they also saw correspondence showing Hunter in that year attempting to describe income as a “loan”—though this time his accountants rejected the request. All told, the IRS team recommended that Hunter face felony charges for 2014, 2018 and 2019. They also recommended misdemeanor charges for “failure to file or pay” for five of the six years.

Democrats defend Hunter by saying that he ended up paying much of his back taxes prior to this plea deal, thanks to a $2 million loan from a Hollywood lawyer. But the second whistleblower explained the IRS view of after-the-fact efforts to get straight with tax authorities. He was asked during testimony: “If someone meets all the elements for a crime of willful evasion and are found to, in conjunction with that, owe a liability, and they pay off that liability years later when they’ve been caught, has a crime still been committed?”

The whistleblower’s response: “Yes.”

The next time President Biden says too many people don’t pay enough taxes, refer him to the moral authority of Hunter.

Throw Hunter Biden’s Plea Deal in the Trash
The IRS whistleblowers say Justice sabotaged the investigation, so how can the agreement stand?

Supervisory Special Agent Gary A. Shapley Jr., a 14-year veteran of the Internal Revenue Service’s Criminal Investigation Division, sat on May 26 for hours of sworn and transcribed testimony with members of the majority and minority staffs of the House Ways and Means Committee. On June 1, an IRS criminal investigator who chose to remain anonymous did the same. These whistleblowers came forward because they believe that Attorney General Merrick Garland gave false assurances to Congress when he testified that he had empowered U.S. Attorney David Weiss with full authority to investigate Hunter Biden’s alleged criminal activity and bring any resulting charges.

The plea agreement reportedly reached between Mr. Weiss and the president’s son gives credence to the whistleblowers’ statements. The judge to whom that agreement is presented on July 26 ought to consider rejecting it.


IRS special agents are the agency’s criminal investigators. They are the best in the world at tracking down the proceeds of crime. Because of this, they are frequently invited by other federal law-enforcement agencies to participate in matters far removed from tax crimes. They work hand-in-glove with assistant U.S. attorneys and Justice Department tax prosecutors to obtain search warrants and other authorizations necessary to explore leads.

The IRS opened its investigation into Hunter Biden in November 2018 as an offshoot of an investigation it was conducting of a foreign-based amateur online pornography platform. In October 2019 the Federal Bureau of Investigation learned of certain devices, including laptops, that had been abandoned at a Delaware computer repair shop. According to Mr. Shapley, FBI agents had confirmed within weeks that the devices belonged to Mr. Biden and that their contents were authentic. After taking possession of the devices in December 2019, FBI agents notified the IRS that they likely contained evidence of tax crimes. Notwithstanding this notification and that the FBI had legitimate possession of the devices and unfettered access to their contents, Mr. Shapley’s testimony describes how prosecutors never permitted the IRS special agents to examine them.

This is only one of the roadblocks the whistleblowers claim prosecutors threw in the way of their investigation into Mr. Biden’s financial dealings. The IRS special agents testified that they requested and were denied permission to search the guest house at Joe Biden’s Delaware mansion and the storage locker Hunter Biden maintained in Northern Virginia. The whistleblowers claim they had reason to believe they would find records in those locations of at least some of the numerous pass-through entities that reportedly served as conduits for illicit and likely unreported payments to Hunter Biden and possibly other members of his family.

Federal rules provide that the government generally must prosecute an offense in the district in which it was committed. Charges brought in an improper venue can be dismissed. U.S. attorneys are the chief federal law enforcement officers for their districts. When a U.S. attorney discovers crimes that need to be charged in another district, he generally transfers the case and, if necessary, details some of his own staff to handle it.

By June 2021, Mr. Weiss’s prosecution team had gathered enough evidence to understand that Delaware wasn’t the proper venue in which to prosecute Hunter Biden’s tax crimes. Crimes allegedly committed in 2014 and 2015 would have to be charged in the District of Columbia and those allegedly committed 2016-19 would have to be charged in the Central District of California.

According to the whistleblowers’ testimony, the U.S. attorneys in the capital and Central California refused Mr. Weiss’s requests to charge Hunter Biden in their districts. Mr. Shapley testified that Mr. Weiss then asked “Main DOJ” to name him special counsel and was denied—possibly not for the first time. In March testimony before the Senate Judiciary Committee the attorney general said that although he hadn’t made Mr. Weiss special counsel, he had given Mr. Weiss all the authority he needed to bring charges in any district he deemed appropriate.

But on Oct. 7, 2022, Mr. Shapley claims, Mr. Weiss declared in a meeting of the prosecution team that in fact he wasn’t the final decision maker with respect to charges that might be brought against Hunter Biden. It was this statement that shocked and troubled Mr. Shapley such that he braved the consequences of becoming a whistleblower and sought legal counsel on how to do so.

The Justice Department’s alleged foot-dragging and refusal to permit IRS special agents to follow the evidence allowed the statutes of limitations for 2014 and 2015 to expire, notwithstanding that Mr. Biden’s defense counsel had, according to Mr. Shapley, agreed to more than one extension. Far worse, Mr. Garland’s failure to designate Mr. Weiss a special counsel essentially guaranteed that Mr. Biden wouldn’t be prosecuted for any of his alleged tax crimes.

The “criminal information”—the charging document in the absence of an indictment—prepared by Mr. Weiss’s office, to which Hunter Biden will reportedly plead on July 26, states that Mr. Biden received but didn’t pay federal taxes on “taxable income in excess of $1,500,000.00” in 2017 and in 2018. House Oversight Committee Republicans claim to have seen Treasury Department suspicious-activity reports suggesting that Mr. Biden received vastly more than that during the years the IRS was investigating.

Judges can reject plea agreements. That would be an appropriate disposition here. And Congress, in fulfillment of its oversight obligation, must learn and share with the American public what evidence the IRS gathered, what evidence its agents weren’t permitted to obtain, and what charges might have been brought if they had.

Your question is easy to answer but the point is, that response is a non answer to my point. 

That you can always post a shortcoming of the R party does not make the parties equal, same, "uniparty".  It is the absence of logic, and it is self defeating unless your aim is to lose more elections and prove the all-is-lost outlook right.

Possible reasons to not impeach could be many (I actually answer your question),

1. Republicans have a four vote majority in the House and likely more than four members don't support that action as the best remedy.

2. Maybe impeachments ARE coming.

3.  Impeachment works when the official's own party turns against him or her.  While we fight amongst ourselves no one pressures Democrats to turn against this failure and corruption.

4. Impeachment vote is part of the removal from office process and with fewer than 50 Senators, we also have fewer than the 67 needed to convict and remove, making the action, in a way, moot.

5. Impeach, convict, remove Biden gets us Kamala.

6.  If (when) they do impeach, you can (and will) endlessly argue some other lacking or failing.  Impeachment is one possible path, perhaps a good one because it forces a trial, but not in itself the solution.

Back to my point, "uniparty" means two things are the same, pulling in the same direction, no real difference.  It's a math equation and it's wrong.  Pointing out similarities, flaws or shortcomings one one side does not negate the differences, especially in the context of this thread and topic.

You make so many other great posts and insights.  Why settle for such sloppiness here, with infinitely counterproductive consequences?

If the parties are the same and elections don't matter, why is Neil Gorsuch sitting in Merrick Garland's seat?  It makes no difference?  How is Row v Wade doing? Why did one party make us energy independent and the other canceled the gains and crippled the grid?  That doesn't affect you or the voter or the country?  Bullshit. Why did one one party's policies give people record wage growth and the other reversed it?  Why does one party want math and reading taught in schools and the other wants first graders to know how bad this country is and to question their gender?  Same?  Nonsense.

In one post you mock voting and in another (the same morning) you (rightly) tell how important choosing the right local Sheriff is.  But a major factor bringing people out to vote for local officials is the choice on the national ticket, divided on party lines.  That might not move much in a 70-30 district, but it does in 50-50 contests.

Don't like either candidate?  Too many RINOs?  Well that's why we try to get involved earlier in the process, judge the candidates - to your mocking.

The “missing witness” from the Biden corruption investigation, Israeli professor Dr. Gal Luft, has laid out his bribery allegations against the president’s family in an extraordinary video filmed in an undisclosed location while he’s on the run.

In the 14-minute recording, obtained exclusively by The Post, the fugitive former Israeli army officer claims he was arrested in Cyprus to stop him from testifying to the House Oversight Committee that the Biden family received payments from individuals with alleged ties to Chinese military intelligence and that they had an FBI mole who shared classified information with their benefactors from the China-controlled energy company CEFC.

The self-proclaimed fall guy says he provided the incriminating evidence to six officials from the FBI and the Department of Justice in a secret meeting in Brussels in March 2019 — but alleges that it was covered up.

“I, who volunteered to inform the US government about a potential security breach and about compromising information about a man vying to be the next president, am now being hunted by the very same people who I informed — and may have to live on the run for the rest of my life on the run …”

“I’m not a Republican. I’m not a Democrat. I have no political motive or agenda … I did it out of deep concern that if the Bidens were to come to power, the country would be facing the same traumatic Russia collusion scandal — only this time with China. Sadly, because of the DOJ’s cover-up, this is exactly what happened …”

Israeli professor Dr. Gal Luft laid out his bribery allegations against President Biden’s family in an extraordinary video filmed in an undisclosed location while he’s on the run.


Luft claims he was arrested in Cyprus to stop him from testifying to the House Oversight Committee that the Biden family received payments from individuals with alleged ties to Chinese military intelligence.

“I warned the government about potential risk to the integrity of the 2020 elections … Ask yourself, who is the real criminal in this story?”

The House Oversight chairman, Republican James Comer, who was preparing to interview Luft before Luft disappeared, says the Israeli remains a “potential witness” in the Biden family probe, despite his fugitive status.

It remains to be seen whether Luft is the man who will bring down the Bidens, but he is not going quietly into the sunset.

He is determined to tell the American public his version of the truth.

Calling himself “patient zero of the Biden family investigation,” Luft, 57, says he is innocent of charges of conspiring to sell Chinese weapons to Kenya, Libya and the UAE, of violating the Foreign Agents Registration Act (FARA), and of making a false statement.

He says he was forced to skip bail in Cyprus in April while awaiting extradition “because I did not believe I will receive a fair trial in a New York court.”

‘Make evidence public’
Now he is challenging the government to release the minutes of the Brussels meeting and make public the evidence against him.

“Why did the DOJ choose to unseal the indictment on Nov. 1, 2022, the very same week of the midterm elections?” he asks.

“Could this have anything to do with the fear that once Republicans gain control over Congress and begin to investigate, [the DOJ] cover-up would be on full display?”

Luft says he told the DOJ and the FBI in Brussels that Joe Biden, soon after his vice presidential term ended, had attended a meeting at the Four Seasons Hotel in Washington, DC, with his son Hunter and officials from CEFC.

Luft’s account of the former VP’s presence at that meeting was corroborated 21 months later when the FBI interviewed another attendee, Biden family associate Rob Walker, according to recent testimony before Congress.

Luft disclosed during the Brussels interview that CEFC was paying $100,000 a month to Hunter and $65,000 to his uncle Jim Biden, in exchange for their FBI connections and use of the Biden name to promote China’s Belt and Road Initiative around the world — and that the money was being funneled through Walker.

The Oversight Committee has written to Walker demanding he submit to questioning about his role in distributing more than $1 million from China to at least three of President Biden’s relatives.

The DOJ sent a delegation of six people to meet Luft in Brussels, he alleges: four FBI agents and two prosecutors from the Southern District of New York, Daniel Richenthal and Catherine Ghosh.

Among the FBI contingent was Special Agent Joshua Wilson from the Baltimore field office, who would go on to sign a subpoena later that year to seize Hunter’s abandoned laptop from a Delaware repair shop.

“Why did the government dispatch to Europe so many people?” asks Luft.

“They knew very well I’m a credible witness and I have insider knowledge about the group and individuals that enriched the Biden family.

“Over an intensive two-day meeting, I shared my information about the Biden family’s financial transactions with CEFC, including specific dollar figures. I also provided the name of Rob Walker, who later became known as Hunter Biden’s bagman.”

Think-tank ties
He also told the DOJ and the FBI in Brussels that Hunter had an FBI mole named “One Eye” who had tipped off his CEFC associates, Dr. Patrick Ho and Chairman Ye Jianming, that they were under investigation.

Luft is well connected in intelligence circles in Washington, DC, where he ran a think tank, the Institute for the Analysis of Global Security, with former CIA Director James Woolsey and former national security adviser Robert McFarlane as advisers.

He learned in 2017 that Hunter and Jim Biden were being paid by CEFC because Luft was in partnership at the time with a nonprofit think tank associated with the Chinese company.

When Ho was arrested in 2017 in New York on bribery charges, the first person he tried to call was Hunter Biden, whom he had paid $1 million as a “legal retainer.”

But at his trial, Ho was blocked by prosecutors from mentioning the Bidens, according to Luft.

Ho “paid Hunter Biden a million dollars for God-knows-what [but] was not allowed to mention the word Biden before the jury,” says Luft.

Luft also told the DOJ and the FBI in Brussels that Hunter had an FBI mole named “One Eye” who had tipped off his CEFC associates, Dr. Patrick Ho and Chairman Ye Jianming, that they were under investigation.

“Prosecutor Daniel Richenthal told the judge at the time that mentioning the name Biden would ‘add a political dimension’ to the case, and the judge agreed. Which means if I was brought before a New York court, I would not be allowed to utter the word Brussels or Biden.”

Luft denies the charge that he is an arms dealer: “I was asked by a bona fide arms dealer, an Israeli friend, to inquire with a company I knew if they had an item and what would be the price of an item. This is where the conspiracy ended. No follow-up, no money, no brokering activity.”


He also faces FARA charges of acting as an unregistered foreign agent of CEFC.

“The DOJ says I caused a payment of $6,000 a month to former CIA Director James Woolsey in order to put his name on an article I had ghostwritten for the China Daily newspaper … Woolsey had been an adviser to my think tank since 2002 and nothing in the article represented Chinese interests.”

“Why am I being indicted … for ghostwriting an innocuous article for which I received no payment, let alone from a foreign government, when the mother of all FARA cases, the Bidens’ systemic influence-peddling on behalf of foreign governments, for which they raked [in] millions, goes unpunished?”

Attorney met with government
A curious addendum to Luft’s tale comes in October 2020, days after The Post’s bombshell revelations from Hunter’s laptop.

Luft dispatched his attorney, Robert Henoch, to Washington to meet the Trump administration’s acting Deputy Attorney General Richard Donoghue to repeat the allegations he had made in Brussels.

Donoghue also had been assigned by Attorney General Bill Barr in February 2020 to coordinate federal investigations into all Ukraine-related corruption allegations against Joe Biden.

Unbeknownst to Luft, on Sept. 4, Donoghue had ordered the Delaware US attorney to pause the criminal investigation into Hunter to avoid leaks in the two months before the election, according to testimony before Congress.

Donoghue agreed to meet Henoch at a Starbucks near DOJ headquarters and corresponded on his private email, says Luft, who showed The Post the emails between his attorney and the senior official.

“The story is about corruption at the very highest levels of government/politics and I think it can all be corroborated,” Henoch wrote.

Nothing ever came of the meeting — until February of this year, when Luft was arrested in Cyprus.
